Land Disturbance Exemption

Land disturbing activity: Any activity which may result in soil erosion from water or wind and the movement of sediments into state waters or onto lands within the state, including, but not limited to, clearing, dredging, grading, excavating, transporting, and filling of land but not including agricultural practices as described in subsection 30-33(5).

Call the Planning Department at 706-865-6768 before undertaking land disturbance activities.


Any project where the land disturbance is greater than 1 acre or within 200 feet of state waters, requires an erosion control plan that is drawn by a state licensed engineer. If applying for a Land Disturbance Permit, please contact the Planning Department at 706-865-6768 for information on the application requirements and process.

Any land disturbance project that is less than 1 acre or zoned Agricultural and not within 200 feet of state waters will have to sign an exemption form. If applying for an Exemption, please submit the following documents:

  • Completed Exemption Form
  • Recorded Plat- area of disturbance should be drawn on the plat

Tree Cutting Permit

This application applies to any cutting of trees eight inches, or greater, in diameter as part of the ongoing maintenance of property in a Mountain and Hillside Protection area- which does not require a land disturbing permit or building permit.

To be supplied in addition to the tree cutting permit application:

  • Plat of property where the tree cutting will occur
  • Mountain Protection Plan
  • $100 fee will be assessed for permit issuance

Variances

When presented under extenuating circumstances, certain codes and ordinances may be deferred in a ruling. This form is used to signify such a circumstance and apply for a deviation in zoning ruling.

The applicant will be required to attend a Regular Session meeting with the Planning Commission upon complete submittal of the variance application, which includes the following:

  • Completed Application
  • Recorded Plat of the subject property
  • Documentation of Hardship and any other documentation that adequately supports the request
  • A payment of $100 for the application fee

Upon application submittal, the applicant will be provided with the Regular Session meeting date, time, and location. Deadline for submittal is the Wednesday before the last Monday of the month. See the Planning Commission webpage for the Planning Commission Calendar.

For Land Use variances, please contact the Planning Office for a pre-application meeting as the requirements, processing, and procedures differ from standard code section variances.


Sign Permit Application

In addition to the completed sign permit application, the following must be provided:

  • Drawings of boundary survey or tax plat of the proposed sign location
  • Drawing of sign that includes height, width, colors to be used, and structural supports
  • A $50 fee will be assessed at the time of permit issuance

This application does not include any building permits, such as for electrical, that may be required for the proposed sign. Please contact the Building Department at 706-865-6496 regarding additional permitting requirements that may apply.
